Sorry for necro posting in a thread that has been dormant for 14 years, but I listened to the ANTIC podcast with Jay Balakrishnan, founder of Human Engineered Software which later merged (?) with another company to become HESware. That other company were building RF modulators for Commodore, and as part of their work, Jay mentions the company got to borrow a C64 prototype before the launch.

With previous experience of the PET and VIC-20, they quickly got into the new computer despite no documentation was provided. Here comes the interesting claim: Jay says that HESware developed Retroball based on what they found out about the new C64, and that it was ready to be launched on cartridge when the C64 started to sell. Furthermore he claims that Commodore themselves didn't have any games software ready at the launch, which would make Retroball the first C64 game ever. As noted above in this thread, it doesn't look to be entirely true but possibly it was the first 3rd party game, depending on how long before the official launch that other developers got access to it. From what I remember part of the reason why the Commodore software is believed to be first is because they outsourced to HAL Laboratory in Japan, where the Commodore MAX Machine was released six months prior to the C64 in North America. HAL was a tiny, tiny operation at the time which had experience with the 6502 (and PET), Commodore obviously wanted to save money.

They seem to have put out a lot of software for the doomed machine in a very short period of time, all first party even in Japan. Several of the earliest C64 games are in fact, MAX Machine games with all the restrictions of that hardware and therefore should have been ready for the C64 launch - but whether they count as C64 games is I suppose another question, as is whether Commodore actually had the cartridges made on time.

If you count it, it's quite possible even if the stories about other companies in NA are true, Japanese carts were sold in Japan first. I'm pretty sure the C64 itself was only sold as an import there though, so if you don't count MAX software, it definitely doesn't cut it. Of course, I don't think any of those early titles' developments are documented - at least in English. HAL quickly moved on to bigger and better things, expanded and somehow nobody's ever been interested in that part of their history. Find some Japanese magazines from February-August 1982 and you'll have your answer.
